For undocumented people in the United States, it is always a scary thought to consider that you or your loved ones might be detained and deported.  At Casa Freehold, we do everything we can to prevent people from being detained or deported, and keeping families safe is our mission.  However, in these difficult times, undocumented people have a high risk of being detained or deported.

The best thing to do is to be prepared.  When a person is deported, they are forced to leave the United States.  If that person has custody of children on under the age of 18 years old (especially US citizen children), the situation becomes complicated.  The child or children will either be sent to live with the parents in their country of deportation, put in the foster care system or live with a designated guardian in the US.  The United States foster care system is terrible, and children are often neglected or abused.  If the parents want their children to continue living in the US, the best option is to fill out paperwork in advance to transfer custody of the children to live with a trusted adult US citizen or resident if the parents are deported. The documentation MUST be filled out and submitted in advance.  By filling out the paperwork, the children will continue to live with a US citizen or resident of your choice if you are deported.  To be clear, your children will ONLY be put in the designated person's custody IF you are deported or detained, and you will not be in any danger of deportation or detention if you fill it out.  It is simply a backup plan.
